Mr. Pallav Mongia is a seasoned practitioner with over 15 years of experience in complex commercial arbitration, litigation, appellate, and constitutional law matters. A dual-qualified lawyer, he is an Advocate-on-Record at the Supreme Court of India and a Solicitor in England & Wales. Mr. Mongia's practice primarily spans the APAC region and includes representing leading conglomerates in high-stakes matters before the Supreme Court and various High Courts in India. He has also acted in international arbitration proceedings under SIAC, DIAC, and UNCITRAL rules, handling a wide spectrum of commercial disputes across jurisdictions.
In dispute resolution, Pallav has represented clients before SIAC and LCIA in international arbitrations involving commodity transactions, mining development agreements, investment conflicts, family settlements, and construction disputes. His practice also encompasses arbitration-related litigation, including cost recovery, award annulments, and enforcement actions.
His commercial litigation practice before the Supreme Court of India and High Courts in India is particularly in matters involving the enforcement of foreign awards, defending arbitration proceedings in anti-arbitration injunction suits. He has also appeared before multiple Constitution Benches of the Supreme Court in cases that have resulted in landmark judgments shaping the law of arbitration in India. Most recently, he successfully defended an oil and gas company in an anti-arbitration injunction suit stemming from Malaysia-seated arbitration.
He has appeared and argued before the Constitution Bench of the Supreme Court on various occasions. Additionally, his practice includes representing a diverse array of clients—including American, Australian, and Chinese corporations, as well as individuals—in commercial litigation and recovery cases before District Courts, Tribunals, and High Courts.
Pallav frequently appears before the National Company Law Appellate Tribunal (NCLAT) and National Company Law Tribunal (NCLT), handling matters related to the Insolvency and Bankruptcy Code and Company Law.
In addition, his litigation experience encompasses cases involving mines, minerals, and land. In different matters, he has also appeared before the Supreme Court in a matter concerning the retrospective levy of DMF and is presently engaged in a case examining both the prospective and retrospective application of the Mines and Minerals (Development & Regulation) Amendment Act, 2015, along with the interpretation of Section 10-A(2)(c) of the MMDR Act.
In terms of his regulatory practice, he has represented clients from the sectors of electricity, solar energy, mining, renewable energy, etc., and successfully represented the clients before various fora such as CERC, APTEL, High Courts, and the Supreme Court. In relation to the electricity sector, he has advised and represented associations, renewable energy companies, transmission licensees, and regulatory authorities and has vast experience in handling tariff matters.
Supreme Court Practice
Mr. Pallav Mongia has been practising before the Supreme Court of India since 2012 and has been an Advocate-on-Record since 2017. His practice spans a wide range of civil, criminal, constitutional, land acquisition, service, and matrimonial disputes. He has led and argued complex matters involving constitutional challenges, statutory interpretation, land acquisition and high-stakes property and service law appeals. He regularly appears in criminal matters involving serious offences, economic crimes, death penalty cases, applications for bail, quashing, and suspension of sentence. Mr. Mongia also represents parties in family and matrimonial disputes, frequently in transfer petitions and mediated settlements, and is actively engaged in constitutional litigation pertaining to validity of legislations, executive actions, and public rights.
High-Stakes Litigation
Apart from arbitration, Pallav is also experienced with high-stakes litigation:
- He is defending a large private bank against India's largest public sector bank in a dispute arising out of sale of shares of one of India's largest alcohol beverage company;
- He has also acted in high-stakes civil and reputational litigation for prominent public figures, including multiple Bollywood celebrities and production company of one of the highest grossing comedy shows in India before High Courts of Delhi and Punjab & Haryana;
- His engagement in public law cases, include legal challenge to constitutional amendment abrogating Article 370 (recognising semi-autonomous status of the State of Jammu & Kashmir) of the Constitution of India, the Ram Mandir land dispute (concerning title and religious rights over the site claimed as the birthplace of the Hindu deity Lord Rama), and constitutionality of Section 377 of the Indian Penal Code (decriminalisation of consensual sex between homosexuals).
Honors and Recognition
Pallav is a proud recipient of the Justice J.S. Verma Fellowship by the Supreme Court Lawyers Welfare Trust in 2012. He now serves as a trustee of the fellowship fund, working alongside eminent legal figures including Mr. Justice Aftab Alam (Retd., Supreme Court of India), Mr. Gopal Sankaranarayanan, Sr. Adv and Mr. C.U. Singh, Senior Advocate.
As an empanelled arbitrator with the Delhi International Arbitration Centre, Pallav has adjudicated disputes and issued awards as sole arbitrator on matters relating to provision of services and supply of goods. He is empanelled with the Gujarat International Maritime Arbitration Centre and Dubai International Arbitration Centre. He also serves on the Young Steering Committee of the International Arbitration and Mediation Centre, Hyderabad.
